1. Acceptance of Terms

By accessing or using Upolivanex ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is provided by Smart Technology Investments LLC ("Company", "we", "us").

2. Description of Service

Upolivanex provides decision intelligence tools that help users make informed financial decisions using publicly available data. The Service includes calculators, analysis tools, downloadable reports, and API access. All calculations are based on published data sources and mathematical models.

3. Not Professional Advice

The Service provides mathematical analysis and data aggregation only. It does not constitute financial, tax, legal, medical, or professional advice. You should consult qualified professionals before making decisions based on our analysis. Results are estimates based on the inputs you provide and publicly available data.

4. User Accounts

You may create an account to access premium features. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Payments and Refunds

Premium reports and API access are sold on a per-report or subscription basis. All payments are processed securely through Stripe. Refunds may be issued at our discretion within 30 days of purchase if the Service fails to deliver the advertised analysis.

6. Intellectual Property

All content, algorithms, user interfaces, and documentation are owned by Smart Technology Investments LLC. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Reports generated for you are licensed for your personal or internal business use only.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Dispute Resolution

Any disputes arising from these terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Los Angeles County, California. You waive the right to participate in class action lawsuits.

9. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify registered users of material changes via email.

10. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Los Angeles County, California.
